We are all naturally sensitive about providing our personal details online, and we would therefore like to assure you that your details will only be used in connection with the WaterAid Ball.
We need your name and mobile phone number so that we can identify you when you bid. If you would like to use our web app to bid, we will need your email address so that we can send you your personalised bidding link. We also ask that you provide postal and email address details so that we can contact you if you are lucky enough to win an item or if we need to communicate some other information to you about the event. This information will also be shared with WaterAid in order to facilitate winning bids and donations. You can read more about how WaterAid processes information here. These are the only circumstances in which we will use your information.
TERMS AND CONDITIONS FOR Anglian Water WaterAid Ball - Silent and Live AUCTIONS: 20th April 2024
These terms and conditions (the 'Terms and Conditions') govern any participation in these charitable auctions (the "Auctions"). By bidding in the Auctions, you expressly agree to be bound by these Terms and Conditions.
General
Profits from these Auctions, conducted by WaterAid, Anglian Water and the Anglian Water WaterAid Committee (the Organisers) will be donated to the WaterAid charity in support of the Beacon Project in Nepal.
The successful bidder will be asked to make immediate payment by credit or debit card accordance with Clause 4.b. Full details will be supplied to the winning bidder when the Auctions are over.
Bidders must be at least 18 years of age.
Each placement of a bid will constitute a legal offer which will form an agreement which will be binding on the bidder.
Bidding process
Persons wishing to enter the Silent Auction must register with SilentBid including their name and contact details.
The Silent Auction will be run on Saturday 20th April 2024, with the closing time expected to be midnight. The Organisers reserve the right to change the closing time at its discretion.
The winning bid in the Silent auction will be the highest bid at the time of closing the auction. If there is a problem with payment by the successful bidder of the amount of the winning bid, the Organisers reserve the right to offer the Items to the next highest bidder.
The Organisers reserves the right to refuse or remove bids in its absolute discretion.
If there is a dispute between bidders, the Organisers are under no obligation to become involved in such a dispute. The Organisers, its officers, employees and agents are hereby released from any claims, demands or damages arising out of or in connection with any such disputes.
Items
Items bought through the Auctions are non-refundable and non-exchangeable.
Bidders acknowledge that all information that is provided in the Auction Brochure, and on the SilentBid App, as a description of the Items is produced in good faith. As such, the Organisers cannot be held responsible for inaccurate or misleading descriptions.
To the extent permissible in law neither Anglian Water nor WaterAid accept any responsibility for any damage, loss, liabilities, injury or disappointment whatsoever, howsoever incurred or suffered by you as a result of your participation in the Auctions or use of the prizes.
Payment
Payment for the Auction Items must be received on the evening of 20th April 2024 or the following morning (21st April 2024)
Unless otherwise agreed by the Organisers items will not be released until payment has been received.
The Auctions will be conducted in pounds Sterling and the amount of the Winning Bid shall is inclusive of any applicable VAT.
Data Protection
The Organisers comply with the provisions of the UK GDPR and Data Protection Act 2018 in processing personal information. As such, your personal information will be held confidentially by the Organisers and will only be used or disclosed to a third party if such use or disclosure is required for the purposes of payment and/ or delivering the Items to the winning bidder or as otherwise instructed by you.
By registering you agree that your personal data will be used to facilitate and process payments if you are the winning bidder. The Organisers and SilentBid will not use details provided for any other purpose than to communicate regarding the Auctions.
Severability
If any provision of these terms and conditions shall be prohibited by or adjudged by a Court to be unlawful void or unenforceable the remaining terms and conditions shall remain in full force and effect.
Third Party Rights
This Agreement does not create or confer any right under the Contracts (Rights of Third Parties) Act 1999 which are enforceable by any person who is not a party to this Agreement.
Limitation
All bidders agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or in relation to an Auction or these terms and conditions must be filed within one (1) year after such claim or cause of action arises or be forever barred.
Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of England and Wales whose courts shall be courts of competent jurisdiction. Access to and participation by you in the Auction is confirmation that you have understood and accepted the above Terms and Conditions.
